3. Terms & Conditions

Section 1 — Scope
These Terms and Conditions apply to all contracts concluded via https://www.viscon.biz between AD Studio ([FIRST NAME LAST NAME], sole trader, Vienna, Austria) and the customer. Deviating terms and conditions are not accepted.
Section 2 — Subject Matter
The subject matter is the paid transfer of digital PSD mockup files for download. These are exclusively digital products with no physical delivery.
Section 3 — Contract Formation
The display of products on the website does not constitute a binding offer. By clicking the purchase button, the customer submits a binding order. Acceptance occurs through a confirmation email and provision of the download link.
Section 4 — Prices and Payment
All prices are final prices in Euros (EUR). Payment is processed via Stripe (Stripe Payments Europe Ltd., Dublin, Ireland). Accepted methods: credit card (Visa, Mastercard), Apple Pay, Google Pay.
Section 5 — Delivery of Digital Content
After successful payment, the customer immediately receives a download link by email and access to the download via their customer account. For technical issues, contact: design@viscon.biz
Section 6 — Right of Withdrawal for Digital Content
The right of withdrawal expires for digital content when the trader has begun performance after the consumer (a) has expressly consented to the trader beginning performance before the expiry of the withdrawal period, and (b) has acknowledged losing the right of withdrawal (pursuant to Sec. 18 para. 1 no. 11 FAGG). The customer confirms both via a mandatory checkbox during checkout.
Section 7 — License and Usage Rights
Upon purchase, the customer acquires a non-exclusive, non-transferable license for personal and commercial projects (unlimited projects and clients).
Prohibited: sharing, reselling, or redistributing the files in any form. All intellectual property rights remain exclusively with AD Studio.
Section 8 — Warranty
AD Studio warrants that the digital products correspond to the described specifications at the time of delivery. For defects, contact design@viscon.biz. Statutory warranty rights remain unaffected.
Section 9 — Limitation of Liability
AD Studio is not liable for damages arising from improper use of the files. Liability for slight negligence is excluded to the extent permitted by law. Liability for personal injury remains unaffected.
Section 10 — Governing Law and Jurisdiction
Austrian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for contracts with business customers is Vienna, Austria.
§ 1 — Geltungsbereich
Diese AGB gelten fuer alle Vertraege, die ueber https://www.viscon.biz zwischen AD Studio ([VORNAME NACHNAME], Einzelunternehmer, Wien, Oesterreich) und dem Kunden geschlossen werden. Abweichende Kundenbedingungen werden nicht anerkannt.
§ 2 — Vertragsgegenstand
Gegenstand ist die entgeltliche Ueberlassung digitaler PSD-Mockup-Dateien zum Download. Es handelt sich ausschliesslich um digitale Produkte ohne physische Lieferung.
§ 3 — Vertragsschluss
Die Darstellung der Produkte auf der Website ist kein bindendes Angebot. Durch Klick auf den Kaufen-Button gibt der Kunde eine verbindliche Bestellung ab. Die Annahme erfolgt durch Bestaettigungs-E-Mail und Bereitstellung des Download-Links.
§ 4 — Preise und Zahlung
Alle Preise sind Endpreise in Euro (EUR). Die Zahlung erfolgt ueber Stripe (Stripe Payments Europe Ltd., Dublin, Irland). Akzeptierte Zahlungsmethoden: Kreditkarte (Visa, Mastercard), Apple Pay, Google Pay.
§ 5 — Lieferung digitaler Inhalte
Nach erfolgreicher Zahlung erhaelt der Kunde unverzueglich einen Download-Link per E-Mail sowie Zugang zum Download ueber sein Kundenkonto. Bei technischen Problemen: design@viscon.biz
§ 6 — Widerrufsrecht bei digitalen Inhalten
Das Widerrufsrecht erlischt bei digitalen Inhalten, wenn der Unternehmer mit der Ausfuehrung begonnen hat, nachdem der Verbraucher (a) ausdruecklich zugestimmt hat, dass der Unternehmer vor Ablauf der Widerrufsfrist mit der Ausfuehrung beginnt, und (b) seine Kenntnis bestaetigt hat, dass er damit sein Widerrufsrecht verliert (gemaess § 18 Abs. 1 Z 11 FAGG). Der Kunde bestaetigt beides per Pflicht-Checkbox beim Bestellvorgang.
§ 7 — Lizenz und Nutzungsrechte
Mit dem Kauf erwirbt der Kunde ein nicht-exklusives, nicht uebertragbares Nutzungsrecht fuer persoenliche und kommerzielle Projekte (unbegrenzte Anzahl an Projekten und Kunden).
Verboten: Weitergabe, Weiterverkauf oder Weiterverteilung der Dateien in jeglicher Form. Das Urheberrecht verbleibt ausschliesslich bei AD Studio.
§ 8 — Gewaehrleistung
AD Studio gewaehrleistet, dass die digitalen Produkte zum Zeitpunkt der Bereitstellung den beschriebenen Spezifikationen entsprechen. Bei Maengeln: design@viscon.biz. Die gesetzliche Gewaehrleistungspflicht bleibt unveraendert.
§ 9 — Haftungsbeschraenkung
AD Studio haftet nicht fuer Schaeden, die durch unsachgemaesse Verwendung entstehen. Die Haftung fuer leichte Fahrlaessigkeit ist, soweit gesetzlich zulaessig, ausgeschlossen. Die Haftung fuer Personenschaeden bleibt unveraendert.
§ 10 — Anwendbares Recht und Gerichtsstand
Es gilt oesterreichisches Recht unter Ausschluss des UN-Kaufrechts (CISG). Gerichtsstand fuer Vertraege mit Unternehmern ist Wien, Oesterreich.

Expiry of Right of Withdrawal for Digital Content
The right of withdrawal expires for digital content where AD Studio has begun performance after you (a) have expressly consented to performance beginning before the expiry of the withdrawal period, and (b) have acknowledged that you thereby lose your right of withdrawal.
This consent is given via the mandatory checkbox at checkout: “I agree that the download is provided immediately and I thereby lose my right of withdrawal.”
Consequences of Withdrawal
If you effectively withdraw, we will reimburse all payments without undue delay and no later than 14 days after receipt of your withdrawal notice, using the same payment method as the original transaction.

Widerrufsrecht

Erloeschen des Widerrufsrechts bei digitalen Inhalten
Das Widerrufsrecht erlischt bei digitalen Inhalten, wenn AD Studio mit der Ausfuehrung begonnen hat, nachdem Sie (a) ausdruecklich zugestimmt haben und (b) bestaetigt haben, dass Sie damit Ihr Widerrufsrecht verlieren (gemaess § 18 Abs. 1 Z 11 FAGG).
Die Zustimmung erfolgt per Pflicht-Checkbox beim Kauf: “Ich stimme zu, dass der Download sofort bereitgestellt wird und ich damit mein Widerrufsrecht verliere.”
Folgen des Widerrufs
Im Falle eines wirksamen Widerrufs erstatten wir alle Zahlungen unverzueglich, spaetestens binnen 14 Tagen ab Eingang Ihrer Widerrufsmitteilung, ueber dasselbe Zahlungsmittel.
